Terms of Service

GomiSense is a mobile application that helps users understand and follow Japan's waste separation and disposal rules. The Service provides AI-powered waste identification, neighborhood-specific disposal guidance, collection calendars, recycling point maps, and related features.

The information provided by GomiSense is intended as a helpful guide only. Waste disposal rules in Japan vary by municipality and are subject to change. Always verify with your local municipality for the most current rules.

• •You may use GomiSense without creating an account, but certain features require account registration.
• •You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• •You must be at least 13 years of age to create an account.
• •You agree to provide accurate, current, and complete information and to update it as necessary.
• •We reserve the right to suspend or terminate accounts that violate these Terms.

GomiSense offers both a free tier and paid premium subscriptions:

• •Free tier: Up to 10 AI scans per month, access to the waste guide, collection calendar, and recycling map.
• •Premium Monthly: Unlimited AI scans and advanced features, billed monthly.
• •Premium Yearly: Unlimited AI scans and advanced features, billed annually at a discounted rate.

Subscriptions are managed through RevenueCat and processed via the App Store or Google Play Store. Subscription fees are non-refundable except where required by applicable law or platform policies. You may cancel your subscription at any time through your device's app store settings; cancellation takes effect at the end of the current billing period.

You agree not to:

• •Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• •Attempt to gain unauthorized access to any portion of the Service or its related systems
• •Reverse engineer, decompile, or disassemble any part of the Service
• •Use automated bots, scrapers, or other tools to access the Service without our prior written consent
• •Upload or transmit malicious code, spam, or any content that is harmful, offensive, or infringes third-party rights
• •Misuse the AI scanning feature by uploading images unrelated to waste disposal

The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of GomiSense and its licensors. Our trademarks, logos, and service marks may not be used in connection with any product or service without prior written consent.

The GomiSense mascot character, design system, and visual identity are proprietary and may not be reproduced, distributed, or used without explicit written permission.

GomiSense uses artificial intelligence (Google Gemini Vision API) to analyze waste items and provide disposal guidance. AI outputs may occasionally be inaccurate or incomplete. We do not guarantee the accuracy of AI-generated classifications or disposal instructions. GomiSense is not liable for any fines, penalties, or damages resulting from reliance on AI-generated content. Always confirm disposal requirements with your local municipality.

To the maximum extent permitted by applicable law, GomiSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• •Your access to or use of (or inability to access or use) the Service
• •Any conduct or content of any third party on the Service
• •Any content obtained from the Service
• •Unauthorized access, use, or alteration of your transmissions or content
• •Inaccurate waste disposal guidance provided by the AI or database

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

These Terms shall be governed and construed in accordance with the laws applicable in the jurisdiction where GomiSense operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide at least 14 days' notice of material changes by posting the updated Terms in the app and updating the "Last updated" date above. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, please stop using the Service.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
